Welcome to Tracey Jones Photography (hereinafter referred to as “Tracey Jones Photography,” “we,” or “us”)! We are an online digital media retailer that provides our customers with access to photography books, lessons, courses and prints.

These Terms of Use govern your use of our service. As used in these Terms of Use, “Tracey Jones Photography’s service,” “our service” or “the service” means the service provided by Tracey Jones Photography for discovering and purchasing our photography books, lessons, courses and prints, including all features and functionalities, Website (as defined below), and user interfaces, as well as all content and software associated with our service.

By using, visiting, or browsing the Tracey Jones Photography Website, you accept and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use the Tracey Jones Photography service.

The Tracey Jones Photography website, traceyjonesphotography.com (“Website”) and its entire contents, features, and functionality (including, but not limited to, all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by us, our licensors or other providers of such material and are protected by Australian and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. Tracey Jones Photography and any content viewed through our service are for your personal and non-commercial use only.. Except for the foregoing limited license, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

We continually update the Tracey Jones Photography service, In addition, we continually test various aspects of our service, including our website, user interfaces, service levels, plans, promotional features, availability of courses, delivery and pricing. We reserve the right to, and by using our service you agree that we may, include you in or exclude you from these tests without notice. We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website.

You agree to use the Tracey Jones Photography service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, download (other than through caching necessary for personal use), reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through Tracey Jones Photography, without express written permission from Tracey Jones Photography and its licensors. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Tracey Jones Photography’s service; use any robot, spider, scraper or other automated means to access Tracey Jones Photography’s; decompile, reverse engineer or disassemble any software or other products or processes accessible through Tracey Jones Photography; insert any code or product or manipulate the content of Tracey Jones Photography in any way; use any data mining, data gathering or extraction method and attempt to interfere with the proper working of the Website and Tracey Jones Photography services. You also agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with Tracey Jones Photography, including any software viruses or any other computer code, files or programs. 8. The availability of courses and lessons will change from time to time. 

 

9. Disclaimers of Warranties and Limitations on Liability.

  1. You understand that we cannot and do not guarantee or warrant that files available for downloading from the Internet or the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

NEITHER TRACEY JONES PHOTOGRAPHY NOR ANY PERSON ASSOCIATED WITH TRACEY JONES PHOTOGRAPHY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF TRACEY JONES PHOTOGRAPHY’S SERVICES, SOFTWARE AND CONTENT. 10. Gifts & Promotions. In certain jurisdictions, redemption/gift cards for Tracey Jones Photography may be available for purchase at third-party retail outlets and websites, which can be redeemed on our website at (insert link). The purchase and redemption of gift cards are subject to the redemption terms (insert link). From time to time, other types of promotional codes may be available, including those provided as part of a third party promotion. Promotional codes may be redeemed as described in the specifics of the promotion. Gift cards and promotional codes can only be used once, cannot be redeemed for cash, and may be combined with other offers, subject to certain restrictions as determined by Tracey Jones Photography in its sole discretion. If you received a promotional code through an offer by a third party, additional conditions may apply.

These Applications are provided solely as a convenience to you, and Tracey Jones Photography is not responsible for such Applications. SUCH APPLICATIONS ARE OWNED OR OPERATED BY THIRD PARTIES THAT ARE NOT RELATED TO WITH OR SPONSORED BY SHUTTERMONKEYS AND MAY NOT BE AUTHORIZED FOR USE WITH OUR SERVICE IN ALL COUNTRIES. USE OF AN APPLICATION IS AT YOUR OWN OPTION AND RISK.

 

13. Use of Information Submitted. Tracey Jones Photography is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to us (“Feedback”), including responses to questionnaires or through postings to the Tracey Jones Photography service, including the Website and user interfaces, worldwide and in perpetuity without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Tracey Jones Photography service. In addition, you agree not to enforce any “moral rights” in and to the Feedback, to the extent permitted by applicable law. Please note Tracey Jones Photography does not accept unsolicited materials or ideas for classes or training, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Tracey Jones Photography. Should you send any unsolicited materials or ideas, you do so with the understanding that no additional consideration of any sort will be provided to you, and you are waiving any claim against Tracey Jones Photography and its affiliates regarding the use of such materials and ideas, even if material or an idea is used that is substantially similar to the material or idea you sent.

   

14. Indemnification. You agree to defend, indemnify and hold harmless Tracey Jones Photography, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Website, including, but not limited to, your User Contributions, any use of the Website’s content, services and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website.

15. Entire Agreement. The Terms of Use, our Privacy Policy and Terms of Sale, constitute the sole and entire agreement between you and Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

16. Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

17.Testimonials.

By submitting a testimonial to Tracey Jones Photography via our forms, video, social media accounts, comment boxes or electronic or print communication you hereby grant Tracey Jones Photography, its affiliates and related entities the right to use your name, image and quote, or any portion thereof, that you have provided to Tracey Jones Photography in connection with any marketing or branding by or on behalf of Tracey Jones Photography and its affiliates. You have full power and authority to grant the rights stated above. Tracey Jones Photography is not responsible for the content or the accuracy of such information.

  2. You further agree that we may edit the length of your testimonial and publish edited or partial versions of the testimonial. However, we will never edit a testimonial in such a way as to create a misleading impression of your views. You may terminate this license by giving to us 30 days' written notice of termination.

 

18. Purchases. Any content, including but not limited to books, courses, videos, prints, and photo gifts, will be for your personal use only. Tracey Jones Photography is and will remain the copyright holder. This content may not be shared, duplicated or modified in any way. 

 

19. Returns. Tracey Jones Photography will not accept the return of any item which appears to be in working order. If you receive your order and it is clearly broken, scratched or damaged please follow these steps:

  1. Take a photograph clearly showing the damage. 

  2. Send this photo, along with a description of the problem to traceyjonesphotography@gmail.com

The damaged product will be reviewed by members of Tracey Jones Photography. You will then receive an email response explaining how to proceed. 

 

20. Cancelation by Tracey Jones Photography of certain events, activities or courses run by Tracey Jones Photography may happen at any time. Members of Tracey Jones Photography will try to contact all participants of said event as quickly and efficiently as possible. Cancelations may occur for but is not limited to any of the following reasons; sickness, bad weather, natural and un-natural dissasters. Transportation issues and equipment failure. Tracey Jones Photography will endeavour to re-schedule the event where possible. If it is not possible to re-schedule the event for whatever reason, Tracey Jones Photography will issue a full refund to all participants. 

 

21. Cancelation by participants of courses, tours and lessons will be accepted up until 1 day before the scheduled appointment or meeting with Tracey Jones Photography. Cancelations made before this time will be entitled to a full refund or will be able to re-schedule their activity. Any cancelations made after this time will receive no refund and will not be able to re-schedule.   

 

22. Privacy. We are committed to protecting Your personal information and using it only as appropriate to provide You with the best possible service, products, and opportunities. Use of this Site constitutes consent to Our collection and use of personal data as outlined herein.

                        I.         Definitions - "Non-Personal Information" (NPI) is information that is in no way personally identifiable and that is obtained automatically when you access our Website with a web browser. "Personally Identifiable Information" (PII) is non-public information that is personally identifiable to you and obtained for us to provide you with a product or service. PII may include information such as your name, address, phone number, and other related information that you provide to us.

                      II.         Our Commitment to Your Privacy - Our Privacy Policy tells you what PII we may collect from you, how we may share your PII, and how you can limit our sharing of your PII. Tracey Jones Photography is committed to the security and privacy of all our customers. We take your privacy seriously, and we will work with you to ensure that you have an enjoyable online experience. You understand that these websites are not under our control and are not subject to our Privacy Policy. These websites will likely have their own privacy policies. We have no responsibility for these websites and provide links to these websites solely for your convenience. You acknowledge that your use and access of these websites is solely at your own risk. It is your responsibility to check the privacy policies of these websites to see how they treat your personal information.

                    IV.         ​Information We Collect - You can visit our Website without providing or revealing PII. However, we may receive and store certain types of NPI when you interact with our Website. We may analyze NPI for trends and statistics as to how people use our Website. Unless you wish to acquire goods or services through our Website, we typically will not require you to provide PII. We receive and store PII that you provide to us when you place an order, send an email or call us, enter a contest, subscribe to a service, request to receive material, or participate in a promotion. In addition to your PII, we may also collect PII that you submit to us about other people, such as the name and address of someone you are referring to us. Even though our Website is not designed for use by anyone under the age of 18 (child), we realize that a child may attempt to access our Website. We do not knowingly collect PII from a child. We may ask for proof of identification before we remove any information to prevent malicious removal of account information. When we collect your PII through our Website, we will encrypt your PII before it travels over the Internet using industry standards for conducting secure online transactions. The information we collect by Web Beacons allows us to statistically monitor the number of people that open our emails and why they opened our emails. Our Web Beacons are not used to track your activity outside of our Website or those of our affiliates. We do not link NPI from Web Beacons to PII without your permission.

Any changes we make to our Privacy Policy are effective as of this Last Updated date and replace any prior Privacy Policies.
