Welcome to Tracey Jones Photography (hereinafter referred to as “Tracey Jones Photography,” “we,” or “us”)! We are an online digital media retailer that provides our customers with access to photography books, lessons, courses and prints. ​These Terms of Use govern your use of our service. As used in these Terms of Use, “Tracey Jones Photography’s service,” “our service” or “the service” means the service provided by Tracey Jones Photography for discovering and purchasing our photography books, lessons, courses and prints, including all features and functionalities, Website (as defined below), and user interfaces, as well as all content and software associated with our service.

These Terms of Use, govern your use of the Tracey Jones Photography service. By using, visiting, or browsing the Tracey Jones Photography Website, you accept and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use the Tracey Jones Photography service.

We reserve the right to, and by using our service you agree that we may, include you in or exclude you from these tests without notice. We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. By using Tracey Jones Photography, you consent to receiving electronic communications from Tracey Jones Photography, including but not limited to, newsletters, receipts, confirmation of purchase, requests for feedback and information about new products and offers. In addition, you agree not to enforce any “moral rights” in and to the Feedback, to the extent permitted by applicable law. Please note Tracey Jones Photography does not accept unsolicited materials or ideas for classes or training, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Tracey Jones Photography. Should you send any unsolicited materials or ideas, you do so with the understanding that no additional consideration of any sort will be provided to you, and you are waiving any claim against Tracey Jones Photography and its affiliates regarding the use of such materials and ideas, even if material or an idea is used that is substantially similar to the material or idea you sent.

  2. Definitions - "Non-Personal Information" (NPI) is information that is in no way personally identifiable and that is obtained automatically when you access our Website with a web browser. "Personally Identifiable Information" (PII) is non-public information that is personally identifiable to you and obtained for us to provide you with a product or service. PII may include information such as your name, address, phone number, and other related information that you provide to us.

viii. Links to Other Websites - Our Website may contain links to other websites. You understand that these websites are not under our control and are not subject to our Privacy Policy. These websites will likely have their own privacy policies. We have no responsibility for these websites and provide links to these websites solely for your convenience. You acknowledge that your use and access of these websites is solely at your own risk. It is your responsibility to check the privacy policies of these websites to see how they treat your personal information.

  1. Protecting Your Child's Privacy - We follow the Children's Online Privacy Protection Act (COPPA). Even though our Website is not designed for use by anyone under the age of 18 (child), we realize that a child may attempt to access our Website. We do not knowingly collect PII from a child. If you are a parent or guardian and believe your child is using our Website, please contact us. We may ask for proof of identification before we remove any information to prevent malicious removal of account information. If we discover on our own that an unauthorized child is accessing our Website, we will delete the information as soon as we discover it, we will not use the information for any purpose, and we will not disclose the information to third parties. You acknowledge that we do not verify the age of our users nor do we have any liability to do so. If you are a child, please seek the permission of a parent or guardian before accessing our Website.
  2. Why do we collect this information – We will collect information about you and your photography habits. This may include some information about your business. Any information that we collect will be used to improve your experience and to help us provide you with the best possible service.
  3. How do we keep this information safe? - Any PII that we collect will be kept inside secure cloud locations which have password access. These cloud services may be run by third parties but they will not have access to the information stored there.

xii. How long is this information kept? – We may hold onto your information for up to 7 years from the date of your last interaction with Tracey Jones Photography. However if you wish for us to delete your information earlier than this you may request to do so by sending us an email using the Contact us information found on our Website.

 

 

Changes to Our Privacy Policy

  1. As necessary to address changes in laws or our business practices, we may modify our Privacy Policy, in whole or in part, to address these changes. We will typically notify users by some message on our Website home page that our Privacy Policy has changed. We will also change the "Last Updated" date at the beginning of this Privacy Policy. Payment methods

Accepted modes of payment:

Coupons 

 Coupons are not transferable and are not redeemable for cash and cannot be combined with any other coupons or any other offer or discounts or promotions offered by Tracey Jones Photography

Each coupon is identified by a code which must be entered at checkout or presented in person, via the phone or messaging service when booking the service. 

The coupon is only valid for the discount mentioned on the voucher, advert, social media post or email where the coupon is displayed. 

The coupon is only valid for the time frame specified on the voucher, advert, social media post or email where the coupon is displayed. When no time frame is specified there is no end date. 

Lost coupon cannot be replaced. 

Coupons cannot be used on purchases already made with Tracey Jones Photography.

Tracey Jones Photography reserve the right to discontinue a coupon at any time. 

Referral System

  1. Referral Coupon.A referral coupon is specific type of coupon designed to be given to friends and family of past or present clients of Tracey Jones Photography.  Each referral coupon is unique to its referrer and cannot be used by the referrer themselves. Unless specified otherwise on the coupon or in written content associated with the coupon a referral coupon is worth a 5% discount on any service provided by Tracey Jones Photography.
  2. Qualified Referral.A Qualified Referral is defined as a purchase made at Tracey Jones Photography, (either in person, via phone call, via messaging service, via email or through a checkout on www.traceyjonesphotography.com) where a referral coupon is used. Referrers are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals. There's no minimum purchase required for Qualified Referral. 

iii. Referred Customer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). The Referred Customer has to be a new customer who has never purchased from Tracey Jones Photography before. We automatically disqualify suspicious referrals. If someone you referred made their first purchase using your Tracey Jones Photography referral coupon and you didn’t receive your reward, your referral might have been flagged as suspicious. Just send us an email trace[email protected], and we'll sort it out for you.

  1. Reward Coupon. Once a qualified referral has been identified by a new customer to Tracey Jones Photography, the referrer will receive a reward coupon. The reward coupon will grant a 5% discount on any service by Tracey Jones Photography to the referrer. 
  2. Coupon Terms.Both referral coupons and reward coupons are subject to the terms and conditions stated in the Coupons section above. 
  3. Eligibility. Eligibility is limited to individuals only

vii. No Spam. You must comply with all up-to-date “SPAM” laws. Any distribution of your referral coupon that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate  exclusion from Tracey Jones Photography's referral program. 

viii. Right to Cancel Program or Change Terms. Tracey Jones Photography reserves the right to cancel our Referral Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed referral rewards will be forfeited at that time.

 

 

Disclaimers of Warranties and Limitations on Liability.

  1. You understand that we cannot and do not guarantee or warrant that files available for downloading from the Internet or the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

THE TRACEY JONES PHOTOGRAPHY SERVICE AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE TRACEY JONES PHOTOGRAPHY SERVICE, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. NEITHER TRACEY JONES PHOTOGRAPHY NOR ANY PERSON ASSOCIATED WITH TRACEY JONES PHOTOGRAPHY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF TRACEY JONES PHOTOGRAPHY’S SERVICES, SOFTWARE AND CONTENT. Jurisdiction & Governing Law

The purchase and redemption of gift cards are subject to the redemption terms (insert link). From time to time, other types of promotional codes may be available, including those provided as part of a third party promotion. Promotional codes may be redeemed as described in the specifics of the promotion. Gift cards and promotional codes can only be used once, cannot be redeemed for cash, and may be combined with other offers, subject to certain restrictions as determined by Tracey Jones Photography in its sole discretion. Tracey Jones Photography and any content viewed through our service are for your personal and non-commercial use only.. Except for the foregoing limited license, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

You agree to use the Tracey Jones Photography service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. DMCA Policy

Entire Agreement

The Terms of Use, our Privacy Policy and Terms of Sale, constitute the sole and entire agreement between you and Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

Survival

If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

By submitting a testimonial to Tracey Jones Photography via our forms, video, social media accounts, comment boxes or electronic or print communication you hereby grant Tracey Jones Photography, its affiliates and related entities the right to use your name, image and quote, or any portion thereof, that you have provided to Tracey Jones Photography in connection with any marketing or branding by or on behalf of Tracey Jones Photography and its affiliates. You have full power and authority to grant the rights stated above. Tracey Jones Photography is not responsible for the content or the accuracy of such information.
  2. You further agree that we may edit the length of your testimonial and publish edited or partial versions of the testimonial. However, we will never edit a testimonial in such a way as to create a misleading impression of your views. You may terminate this license by giving to us 30 days' written notice of termination.

Purchase & Return Policy

  1. Any content, including but not limited to books, courses, videos, prints, and photo gifts, will be for your personal use only. Tracey Jones Photography is and will remain the copyright holder. This content may not be shared, duplicated or modified in any way.
  2. Tracey Jones Photography will not accept the return of any item which appears to be in working order. If you receive your order and it is clearly broken, scratched or damaged please follow these steps:
  3. a) Take a photograph clearly showing the damage.
  4. b) Send this photo, along with a description of the problem to [email protected]

The damaged product will be reviewed by members of Tracey Jones Photography. You will then receive an email response explaining how to proceed.

Cancellations

Unless stated otherwise in an enrolment agreement or contract specific to a course, tour, event or other activity, cancelation by Tracey Jones Photography of certain events, activities, tours or courses run by Tracey Jones Photography may happen at any time. Members of Tracey Jones Photography will try to contact all participants of said event as quickly and efficiently as possible. Cancelations may occur for but is not limited to any of the following reasons; sickness, bad weather, natural and un-natural dissasters. Transportation issues and equipment failure. Tracey Jones Photography will endeavour to re-schedule the event where possible. If it is not possible to re-schedule the event for whatever reason, Tracey Jones Photography will issue a full refund to all participants.

Unless stated otherwise in an enrolment agreement or contract specific to a course, tour, event or other activity, cancelation by participants of courses, tours, lessons, events and other activities will be accepted up until 1 day before the scheduled appointment or meeting with Tracey Jones Photography. Cancelations made before this time will be entitled to a full refund or will be able to re-schedule their activity. Any cancelations made after this time will receive no refund and will not be able to re-schedule.
